DELIVERY AND RETURN TERMS

These Delivery and Return Terms (the "Terms") set out the principles governing the delivery to the BUYER of the biological sample collection kit and genetic analysis service packages (the "Product") offered by Lidya Genomics Yazılım İthalat ve İhracat A.Ş. (the "SELLER" or "Lidya Genomics"), the transmission of the biological sample by the BUYER to the SELLER, the exercise of the right of withdrawal, and the refund of the price.

These Terms are complementary to the Pre-Information Form, the Distance Sales Agreement, the Privacy and Security Policy, the Personal Data Processing Information Notice and other related texts published on the SELLER's website. In case of any conflict between such texts, the provisions of applicable Turkish legislation, primarily the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, shall apply.

These Terms enter into force and effect at the moment the BUYER electronically confirms the order and are binding on all BUYERS purchasing through the SELLER's website.

1. General Provisions

The introductory paragraphs above set out the purpose and binding nature of these Terms.

3.1. Subject of Delivery

Depending on the nature of the package purchased through the SELLER's website, the biological sample collection kit (the "Kit") will be sent to the delivery address declared by the BUYER. Delivery is initiated upon (i) receipt of order confirmation and payment by the SELLER, (ii) the BUYER's approval of the Pre-Information Form and the Distance Sales Agreement, and (iii) completion of the required personal data information notice / explicit consent processes.

3.2. Delivery Time

Following the SELLER's confirmation of the order, the Kit is handed over to the SELLER's contracted shipping company within a reasonable time to be delivered to the BUYER. Under the Regulation on Distance Contracts the legal maximum delivery period is thirty (30) days. The SELLER shall not be liable for disruptions caused by shipping processes or by the carrier; however, upon request, the SELLER will assist the BUYER with shipment tracking to a reasonable extent.

3.3. Shipping Cost

The shipping cost for sending the Kit is borne by the SELLER; no shipping fee is collected from the BUYER. Where cash-on-delivery is used, the cash-on-delivery service fee and the relevant courier information are separately communicated to the BUYER prior to the order.

3.4. Delivery Address and Recipient

The Kit is delivered to the delivery address declared by the BUYER at the time of order and/or to the third party designated by the BUYER. It is the BUYER's responsibility to provide accurate, complete and current address information. The SELLER bears no liability if delivery cannot be made due to incorrect, incomplete or changed address information; any resulting additional shipping, storage or re-shipment costs may be charged to the BUYER.

3.5. Inspection on Receipt

The BUYER is required to inspect the outer appearance, packaging integrity and seal of the package when accepting delivery. If any damage such as crushing, tearing, wetting, broken seal or similar is detected, the package should not be accepted, the situation should be recorded by the courier in writing, and the SELLER should immediately be notified at info@lidyagenomics.com. Failure to comply with this obligation will be deemed acceptance of the Kit in undamaged condition.

3.6. Force Majeure

In the event of natural disaster, pandemic, war, strike, lockout, decisions of public authorities, disruptions to shipping and logistics infrastructure, electricity / internet outages, external events affecting laboratory processes and other force majeure circumstances reasonably beyond the SELLER's control, the SELLER's obligations are temporarily suspended. Such circumstances are not deemed delay or default and no claim of compensation may be made against the SELLER on any basis.

4.1. Sample Collection and Shipping

Following receipt of the Kit, the BUYER is obliged to collect, package and deliver the biological sample to the SELLER in accordance with the instructions included in the Kit and the procedure communicated by the SELLER. The shipping cost for the return of the sample is borne by the SELLER; the return must be made using the contracted courier, shipping code or procedure communicated by the SELLER.

The SELLER is not liable where the sample is not found suitable for analysis due to factors attributable to the BUYER — such as failure to collect, package or ship the sample under appropriate conditions, late shipment, or inability to verify the sample's labeling / identity.

4.2. Rejection or Inability to Analyse the Sample

Samples reaching the SELLER undergo a pre-inspection and acceptance process. If the sample is found unsuitable for analysis due to insufficiency, deterioration, contamination, inadequate quantity or other technical reasons, the SELLER may, at its discretion, re-process the same sample or request a new sample from the BUYER. A second Kit may be shipped where necessary; the shipping and sample-return costs for the second Kit are also borne by the SELLER.

If analysis remains unsuccessful after processing with the second Kit, refund and re-performance conditions will be assessed within the framework of the Pre-Information Form, the Distance Sales Agreement and SELLER policies. Once the sample has been taken into analysis, return of the sample itself is not possible by virtue of the nature of the process.

5.1. Period

Under the Regulation on Distance Contracts, the BUYER has the right to withdraw within fourteen (14) days without giving any reason and without paying any penalty. The withdrawal period begins on the day the Kit is received by the BUYER or by a third party designated by the BUYER. The BUYER may also exercise the right of withdrawal during the period between conclusion of the contract and delivery of the Kit.

5.2. Withdrawal Notice

For the right of withdrawal to be exercised, it is sufficient for the notice to be delivered to the SELLER in writing or by means of a durable medium (for example, by e-mail to info@lidyagenomics.com) before the withdrawal period expires. Including the BUYER's name, surname, order number, the Product to be returned and the bank account (IBAN) to which the refund should be transferred is recommended to expedite the process.

5.3. Cases Where the Right of Withdrawal Cannot Be Used

Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for goods or services that are, by their nature, not returnable, that perish quickly, or that are prepared specifically for the consumer. In particular, the right of withdrawal cannot be used in the following cases:

• The Kit has been used, its packaging / seal has been opened, or it has been contaminated;

• The biological sample has been taken using the Kit and/or sent to the SELLER;

• The sample has been received by the SELLER and the analysis process has been started;

• The digital content or service (e.g., access to the report, results screen) has been opened to the BUYER or performance has begun.

Once the sample is taken into analysis, the Product enters a process of personalised performance and that process is irreversible — from that point the right of withdrawal can no longer be exercised.

5.4. Conditions for Returning the Kit

If the Kit has been delivered to the BUYER but has not yet been used and the biological sample has not been sent to the SELLER, the Kit must be returned under the right of withdrawal (i) in its original packaging, (ii) with its seal / protective caps unopened, (iii) unused, (iv) undamaged and (v) in a condition suitable for resale. Otherwise, return of the Kit may be refused and the BUYER may be held liable for any loss of value.

6.1. Return Shipping

Where the right of withdrawal is exercised in accordance with the law, the shipping cost for returning the Kit to the SELLER is borne by the SELLER. The BUYER carries out the return using the contracted courier, shipping code or procedure communicated by the SELLER. If the BUYER returns the Kit through a courier other than the one designated by the SELLER and this results in additional cost, that additional cost may be borne by the BUYER.

6.2. Return Address

Returns must be sent to the return address communicated by the SELLER. The current return address and return procedure are sent to the BUYER by e-mail after receipt of the withdrawal notice. The risk of products sent to an address other than the return address not reaching the SELLER is borne by the BUYER.

6.3. Practices on Return

• The Kit should be packaged appropriately for return and the original packaging should be preserved.

• Including a short note inside the return package with the order number and the BUYER's contact information is recommended.

• Sharing the courier tracking number with the SELLER helps to expedite the process.

7.1. Refund Period

Where the right of withdrawal is exercised in due form, the SELLER shall refund all payments collected from the BUYER (including standard delivery charges belonging to the BUYER, if any) within fourteen (14) days at the latest from the date the withdrawal notice reaches it. Under the Regulation on Distance Contracts the SELLER may withhold the refund until the returned Kit reaches it.

7.2. Refund Method

The refund amount is paid back using a method consistent with the BUYER's chosen payment method:

• For credit / debit card payments, the refund is made to the card used for payment. The time it takes for the refund to appear in the BUYER's account is subject to the internal processes of banks and payment institutions and is outside the SELLER's control.

• For bank transfer / EFT payments, the refund is made to the IBAN number provided by the BUYER. The BUYER declares and undertakes that the refund IBAN is registered in their own name.

• For cash-on-delivery payments, the refund is made by bank transfer / EFT to the IBAN number provided by the BUYER.

7.3. Refund Amount

The refund amount is calculated over the total Product price paid by the BUYER. Where payment is made in instalments, the bank's practice as to the number of instalments and the duration of the refund to the BUYER's credit card is governed by the contractual relationship between the payment institution and the BUYER; the SELLER bears no liability in this regard.

8. Defective Product and Consumer Rights

If the Kit, as received, is found to be defective within the meaning of Law No. 6502 in terms of its packaging, labeling, quantity or quality, the BUYER notifies the SELLER at info@lidyagenomics.com within a reasonable time from learning of the defect. Upon notification, the SELLER, taking into account the BUYER's optional rights arising from legislation, evaluates together with the BUYER the appropriate option among free repair, replacement of the product with a defect-free counterpart, reduction of the sale price, or rescission of the contract and refund of the price.

The shipping cost for returning a Kit proven to be defective is borne by the SELLER. Cases arising from the BUYER's misuse, improper storage, physical interference or behavior contrary to the instructions included in the Kit fall outside this scope.

9. Cases Where Return Is Not Accepted

In the following cases the Kit will not be accepted for return and no refund will be made:

• The seal / packaging of the Kit has been opened, the Kit has been used or contaminated;

• The biological sample has been taken with the Kit or sent to the SELLER;

• The sample has been received by the SELLER and the analysis process has been started;

• The Kit has been damaged due to the BUYER's misuse, improper storage or wilful / negligent conduct;

• The withdrawal period (14 days) has expired.

10. Contact, Complaints and Dispute Resolution

All questions, requests, notices, withdrawal requests and complaints concerning delivery and return processes may be sent to info@lidyagenomics.com or to the SELLER's postal address indicated above. The SELLER reviews incoming requests within a reasonable time and responds to the BUYER.

For consumer disputes arising from these Terms and matters connected to them, within the monetary thresholds announced annually by the Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the place of residence of the BUYER or at the place where the transaction was made are competent.

11. Protection of Personal Data

Personal data processed within the scope of delivery and return processes (including identity, contact, address, order, payment, transaction-security data and, where necessary, genetic data obtained from biological samples) are processed in accordance with the Personal Data Protection Law No. 6698 and related legislation and within the purposes, legal grounds and retention periods set out in the SELLER's Personal Data Processing Information Notice and the Privacy and Security Policy. The BUYER may exercise the rights arising from the Personal Data Protection Law in accordance with the procedures set forth in those texts.

12. Amendment and Effectiveness

The SELLER reserves the right to unilaterally amend these Terms in light of legislative changes, updates to business processes, operational needs and improvements to the service. The current Terms enter into force on the date they are published on the SELLER's website and apply to orders placed after the date of publication. The Terms in force at the time of an order are binding for that order.

If any provision of these Terms is held to be invalid or unenforceable by a competent authority, the validity of the other provisions shall not be affected.
